yes this is a winter/DD car. I have never had an issue driving a rwd car in the winter as long as it has good snows on it. that being said once the snow reaches about 10-15 cm the height becomes a real issue but I have the truck when that happens. this car is a lot lower than I expected. I would never dream of lowering it considering what ive bottomed out on at stock height.
so I love the car but I just got a stunt driving charge for speeding 50 over the limit so its currently impounded. I was actually doing 120 in an 80 zone but the cop was so pissed that there was a bit of snow on the road that he just said he figured I was doing 150 in an 80 zone. no radar gun just a straight guess. not sure what my rights are here but ya license and car gone for 7 days. I know I was doing 120 cuz I had the cruise set. I know the speedo is accurate cuz I confirmed it with gps. honestly I think im fucked though cuz its gonna be my word against the cops and we all know how that goes. sigh… there goes my 4 year record with no tickets and my phenomenal insurance rate.
I hate that law. It basically makes the cop the judge, and allows him to levy a $750 penalty (tow and impound fees which are not recoverable ) with no burden of proof.
The good news is his evidence will be shit in court. Take notes of everything you can remember. If his evidence is tosh you have a good chance of not being convicted. Or pleading down worst case.
So if he didn’t clock you, how can he write you a ticket for 50 mph over? I would think if you took this to court you could get it thrown out. I am actually fighting getting my license suspended right now, just lawyered up cause I’d rather pay legal fees than lose my license
Assuming this is Ontario (not sure but if it is), cops don’t need any evidence to give you a speeding ticket. Their “word” is considered sufficient. I learned that the hard way when I was 18 years old and asked to see my speed on the cop’s radar gun and he said he deleted it. I took it to court and fought it and asked the cop in cross-examination what proof did he have to be so sure about my speed and the judge interjected on behalf of the cop and said he doesn’t need proof or any sort of evidence.
I was flabbergasted as an 18 year old and it completely boggled my mind. Also took me off guard and after the cop lied on the stand twice, the court sided with his recount of events. I didn’t know any better back then and I hadn’t asked for disclosure and so forth. I thought without any evidence, the ticket would be thrown out. Was a costly lesson.
i had something similar happen to me 6 years ago I ended up getting legal representation. To make a long story short the officer reported in his statement he “paced” me with his cars speedometer doing 70 over lol. the charges were reduced to 15kph over fine no points lost. I think you can beat it if not get it reduced. Best of luck
yer exactly right axel. im fucked because his word is gospel. its a real piss off because I almost never go more than 40 over. I always set cruise when o the hwy and I know for a fact I was doing 120.
this happened on the 7/8 hwy from Kitchener towards Stratford.
a friend of mine went through this on his bike last year ended up costing over 4konce said and done.

all this because he thinks I was going that fast. what fucking bullshit innocent till proven guilty eh.
as ontarians we have lost all rights on the road. I realize I was speeding but not 70 over. this will cost exponential amounts of money in insurance hikes. i don’t think what i was doing warrants the 10k its gonna end up costing.
When I was 19 I was cited for that, along with negligent operation of a motor vehicle for racing a Mazdaspeed 6 in my 3.0 A4. There was barely any traffic but one of the cars that we did pass at about 120 was a town detective in an unmarked Taurus. I had stopped for lunch, went through the drive through and was parking to eat when 4 cruisers boxed me in. The detective gets out of the Taurus pulls out his badge and goes absolutely berserk on me. I was very apologetic and polite to the guy and at my hearing the clerk magistrate gave me a continuance without finding for a year. If I got so much as a parking ticket I would’ve lost my license for 2 years though…

I’ve been doing a lot of reading on the whole thing and it looks to me that my best case scenario is to get the stunt driving dropped and plead to 49 over and hope they don’t give me a massive fine.
I looked into the errors on the ticket and they would only help me if there was a set fine. Seeing as there is no set fine and just a summons for court I can’t use the fatal error approach.
I really think it’s wrong that a single person can have such a massive impact on a person’s life over a wild guess. It seems extremely unconstitutional. His perception of my speed was distorted by a number of things and there’s no way he could accurately judge it. This fuckin sux. I will be taking this all the way to trial so I’ll post back with my results.
Ohio is similar but they can visually estimate up to like 10 mph over the speed limit and the tickets hold up as long as the officer went to a certain training facility. There was an article about this a while ago.
Here in Virginia I have heard police officers say in court that they visually estimated that the person was going a certain speed and then used Lidar/radar or laser to verify the speed. One guy that got that sort of ticket was pretty technically smart so he got the equipment reading thrown out because it wasn’t calibrated correctly according to the manufacture’s specs. He then went on to ask for what specific visual cues showed that he was speeding and the officer gave crappy answers but the judge still found him guilty. Generally your screwed if you get a ticket in VA and reckless driving is either 20+ mph over the limit or 81+ mph.
Just wondering for people that live in other states. When you guys get an out of state ticket do you get points assessed to your license based off the state where you live or the state where you got the ticket?
It depends on the state, but (at least it used to be in IL) you could call a certain number and if you sent them <$200, if you didn’t have any more infractions in 90 days, the ticket seemed to go away. When I did that, my (OH) insurance lady said she haden’t heard anything.
