lots of rumours. I don’t think you can make a ‘settlement’ in a criminal investigation. She has already given a statement, and given evidence. She may have a civil complaint as well, however the police will proceed with their investigation and the state will still prosecute based on the other ‘rumoured’ evidence already gathered (victim statement, and physical evidence gathered at the hospital after she complained of a rape).
If she refuses to testify because she has been paid off, I’m not sure how that will sit in court with the only evidence being her initial statement and the hospital’s rape evidence. It also would make me (if I were a prosecuting attorney) try really hard to nail her to the wall on something. This investigation has probably cost about $50,000 already, with the bill climbing steadily, and the distraction level for that police force being through the roof.
If the rumors in the article are true, then at least the statutory rape violation wouldn’t be on the table. Kane would never have gotten out of that one. And sak is right - there is no settling a criminal case other than the suspect agreeing to a plea bargain. The matter now is in the hands of the local authorities, who will turn over their findings to the Buffalo prosecutors. If the alleged victim doesn’t want to testify, then I don’t see how the prosecution could seek an indictment.
I’m going to wait until more of the facts come out to pass judgment on any possible criminal conduct. A night of clubbing with drugs and alcohol can produce a lot of crazy situations. Unfortunately for Kane, he has a criminal history - so I suspect the police are taking that into consideration and are treating this very seriously. Needless to say, Kane’s an idiot. You don’t put yourself into situations like that when you have an $80 million contract and a likely Hall of Fame career in your grasp.
the police are investigating a rape complaint at his address (the police said this at a press conference)
the district attorney is investigating a rape complaint to determine if charges are worthy of prosecution (the district attorney said this but would name no names)
Kane and Kane’s agent etc. have made no statements or denials of any sort
Whether the reporter is biased, or is adding fuel to the fire with salacious details like someone’s post here earlier that mentioned it being an underage person when in fact it was a 26 year old, is irrelevant. You guys are taking the word of a Chicago biased blog over a supposedly victim-biased reporter. In other words, both sources are useless.
Bottom line is that someone went to his house, someone claimed they were raped at his house and told the police as much, and there’s an investigation. Will it stick? Who knows. I don’t think billion dollar companies (EA Sports) drop someone and waste a multi million dollar campaign on a whim because of an unfounded report by a biased reporter. They do their homework.
I don’t think the rumour is that Kane is innocent and the girl made it up. The rumour is that they don’t have a strong enough case to proceed, and are shelving the idea of charges right now.
Basically this rumour means that a rapist got away with rape…and you guys are cheering for him lol.
I reckon you’ll see the Hawks disappear him. Nobody recovers from a rape rumour without the accuser admitting being discredited (Kobe for example, and I don’t think too many people would consider him a role model).
I really didn’t read the whole thing. But if they don’t have enough evidence to bring charges, it’s hard for me to label him a rapist. Remember that the burden of proof for a civil lawsuit is FAR lower than securing a criminal conviction. Evidence that wouldn’t pass muster at a criminal trial could certainly be enough to file suit against Kane and ultimately win. If there’s any truth to the alleged victim’s side, I reckon she’ll sue him. She would have every incentive to do so.
